DRAFT for lawyer review. This is not legal advice and is not a final customer contract.

Terms of Service

Last updated October 2026. Version draft-2026-10.

These terms are between you and Bhatti Traders Pty Ltd (ABN 64 632 648 198) (“we”, “us”) for the BTD Contracts service. By creating an account you agree to these terms, the Privacy Policy and the Acceptable Use Policy.

The service

BTD Contracts lets a business upload a PDF, send it to named people for electronic signature, and keep a signed PDF and certificate of completion. People who only sign a document do not need an account. They use the unique link we email them.

Your account

You must be able to bind the business you name at sign-up. Keep your login secure and tell us if you suspect unauthorised use. You are responsible for the users of your account and for the contracts you send.

Price and billing

The service is pay as you go. It is not a subscription and there is no monthly platform fee. A$1.50 per contract includes GST. The amount charged for each contract is A$1.50.

A “contract” is one envelope that is successfully sent. Resending the same envelope, reminders, and later signatures do not add another charge. If you void an envelope after it has been sent, the send still counts. Drafts that are never sent are not charged.

We add each send to an invoice for the calendar month in Australia/Sydney and ask Stripe to collect that invoice at the end of the month from the card or BECS Direct Debit you saved. Payment details are collected by Stripe. We do not store full card numbers.

You must save a payment method before you send the first contract, unless your account is marked exempt in our configuration (the operator’s own BTD Rentals workspace is exempt).

If a monthly invoice payment fails, you can keep sending during a grace period of 7 days while you update the payment method. After that grace period, new sends are blocked until the invoice is paid. Viewing and downloading contracts you already sent stays available.

Refunds

Fees are for contracts that were sent. We do not refund a send because a signer later declines, the envelope expires, or you void it after sending. If we fail to provide the service for that send, or the Australian Consumer Law gives you a remedy we cannot exclude, we will refund or re-supply that send. Nothing in these terms excludes rights that cannot be excluded under the Australian Consumer Law.

Electronic signing

You must read the electronic signing disclosure. You are responsible for deciding whether a document may be signed electronically. Wills, some powers of attorney, statutory declarations and deeds often cannot. We do not review your documents for that.

Acceptable use

You must follow the Acceptable Use Policy. We may suspend an account that breaches it, or that does not pay after the grace period.

Privacy

Our Privacy Policy explains how we handle personal information, including storage that may be outside Australia.

Liability

The service is a tool for sending and recording signatures. We do not give legal advice and we are not a party to the contracts you send. To the extent the law allows, our liability for the service in a month is limited to the fees you paid us for that month. We do not exclude liability for death or personal injury caused by negligence, for fraud, or for any guarantee that the Australian Consumer Law says we cannot exclude.

Law

These terms are governed by the laws of New South Wales and the Commonwealth of Australia. The courts of New South Wales have non-exclusive jurisdiction.
